Concerning Full-Time Union Release Positions
ACRE
states: that ACRE officers on full-time union release positions
is a legitimate form of compensation from MTA Metro-North
because the National Labor Relations Act “mirrors” the Railway
Labor Act.
Reality
is: MTA Metro-North operates under the provisions of the
Railway Labor Act, not the National Labor Relations Act.
Even if these documents “mirrored” each other regarding
this issue (which they do not) the Railway Labor Act is
in effect on Metro-North. It is a violation of section 2,
part 4 of the Railway Labor Act for any carrier to subsidize
a union or its officers. Furthermore, each National Labor
Relations Act case that ACRE cited as an example to support
their position on the salary issue was reviewed. Not one
of the three National Labor Relations Act board decisions
offered by ACRE had either any bearing on the issue, nor
was full time release positions ever mentioned. These National
