Appeal For Discipline Time Limits

 

•  Tony Bottalico is considering waiving the time limits for appeals for employee discipline. The only entity that will benefit from waiving these time limits for an appeal to be submitted in a timely fashion is the railroad. The time limits for appeals is contractual and should not be waived without full member approval.

 

•  These time limits were negotiated to ensure employees that have been assessed discipline up to and including dismissal would have their appeals handled with expediency.

 

•  Without constraints placed upon Metro North to process an appeal quickly, the potential exists for the discipline to remain on an employee's record for an undetermined period of time. This situation may prove critical for an employee that has yet to serve time, already served time or has a record suspension in effect.

 

•  Division 1 members that have been assessed discipline after an investigation and are awaiting notification regarding their appeal should contact their Local Chairman and inquire about the status of their appeal. If the member receives an unsatisfactory or evasive response, the member should contact The National Mediation Board and ask for the Arbitration Department to determine if your appeal is on the docket.
