According
to the ACRE Constitution, which was instituted on March
1, 2000; in Section 2 under the heading The Executive Board,
the Constitution clearly states, “The Executive Board will
arrange for a yearly audit of the Executive
Board and Local Division Accounts”.
Upon
a review of ACRE Local Division 9 LM2 reports, which they
filed with the U.S. Department of Labor (DOL), it is obvious
that Local 9 is not in compliance with the ACRE Constitution.
Out of the 8 years (2000 through 2007) ACRE Local Division
9 has filed their LM2 reports; only in 2004 and 2005 did
a Certified Public Account review the local division books.
This is a clear and blatant violation of the ACRE Constitution.
Where
is the oversight of the ACRE Executive Board? Where is the
oversight of ACRE Local Division 9 officers, General Chairman
Mike Doyle, President Dennis O'Keefe, Secretary/Treasurer
Joe Lindenberg, Trustee John Dudek and Trustee Mike Bellucco?
Do they not know the rules, their duties and responsibilities
under the ACRE Constitution and Local Division Bylaws? How
did these ACRE Local Division 9 LM2 reports get filed with
the DOL without the proper review by an outside CPA? Where
are the checks and balances within ACRE? ACRE officers operate
outside of the ACRE Constitution and Local Division Bylaws.
These so-called rules are there to keep the ACRE membership
in line. If you try to exercise your rights under the ACRE
Constitution or Bylaws, ACRE officers just ignore you. How
many times has ACRE members had to go to outside agencies
to get guaranteed information from ACRE?
Local
Division 9 Bylaws state: The Local Division Board Trustee
shall: “Represent the financial interests of the
members and monitor the activities of the Local Division.
Yearly, audit all Local Division 9 books in January for
the previous calendar year, and report the results thereof
to the Officers of Local Division 9 and the membership at
the regular monthly meeting in February”. Has this
ever been accomplished? Why has this never been accomplished?
Who is at fault that this has never been accomplished? Why
can't the ACRE organization follow their own rules and regulations?
Why is there never any accountability in ACRE?
The
following information was obtained from ACRE Local 9 LM2
reports filed with the DOL, which is public information

on the left hand side click on Reports-Labor Organizations,
next screen scroll down to bottom and click on Union (form
LM2, LM3, LM4) or Search. Type in the file #, then hit submit.
Executive Board file # is 541-770; Local 1 is 541-733; Local
9 is 541-704; Local 113 is 541-705.
In
2000, ACRE 9 states that no review of the books was done
by either an outside CPA or the Local Division Trustees.
In
2001, ACRE 9 states the Local Division Trustees reviewed
the books.
In
2002, ACRE 9 states the Local Division Trustees reviewed
the books, the Local Division Trustees did not sign off
on the LM2 report filed with the DOL.
In
2003, ACRE 9 states the Local Division Trustees reviewed
the books, the Local division Trustees did not sign off
on the LM2 report filed with the DOL.
In
2004, ACRE 9 states that Alan J. Wolfson a CPA from Brewster
reviewed the books. ACRE makes no mention if the Local Division
trustees reviewed the books.
In
2005, ACRE 9 states that Alan J. Wolfson a CPA from Brewster
reviewed the books. ACRE makes no mention if the Local Division
Trustees reviewed the books.
In
2006, ACRE 9 states that the Local Division Trustees reviewed
the books.
In
2007, ACRE 9 states that the Local Division Trustees reviewed
the books.
According
to Mike Bellucco, this is the first year since he has been
a Trustee, that ACRE (S/T Joe Lindenberg) has allowed the
Local Division Trustees to see and review the books. Then
who reviewed and certified ACRE Local 9 books in 2006? Did
ACRE make a false statement on their 2006 LM2 reports? Bellucco
also stated that the Trustees did not sign off on and certify
the books for 2007. They met with Joe Lindenberg and reviewed
ACRE Local Division 9 records. In the future looking back
through the Local records, how will anyone ever know if
the Local Division Trustees ever reviewed and certified
the books if they did not sign off on them?
In
2007 Mike Doyle received $59,479. Joe Lindenberg received
$30,002. Dennis O'Keefe received $10,012. Mike Bellucco
received $928. John Dudek received $0. ACRE members compensate
these officers to abide by and uphold the ACRE Constitution
and Local Division Bylaws and to protect the membership's
interests. ACRE officers can't claim ignorance when it comes
to the ACRE Constitution and Local Division Bylaws concerning
the financial integrity of the Local Division books and
records.
On
paper the ACRE organization gives itself the appearance
of being a legitimate organization, when in reality the
ACRE organization just does not work. How much longer can
the ACRE membership just sit by and go on pretending that
the ACRE organization works and its officers are there to
serve the memberships interests? Will the ACRE membership
ever hold ACRE officers accountable for their actions?
The
ACRE organizations greatest asset is an uninformed, uneducated,
kept in the dark membership.
Facts
do not lie, although ACRE officers are capable of lying.
